1. Introduction
The following Privacy Policy applies to all services, products, websites, apps and other services and information (hereinafter "LogObject Services") of LogObject AG and its affiliates (hereinafter "LogObject").
LogObject offers the LogObject Services to its customers and consulting services in relation to the LogObject Services to potential customers (hereinafter the "Customers", individually the "Customer").
For the LogObject Services, LogObject requires and collects from the Customers various data and information about the Customers themselves and/or about other facts and matters concerning the Customers (hereinafter "Data").
LogObject collects, records, organizes, arranges, stores, adapts, modifies, retrieves, queries, uses, transmits, analyzes, disseminates, sells copies, deletes and/or destroys the Data with and/or without the aid of automated processes (hereinafter "Processing" or "Processing").
The Processing of the Data is a basic requirement and therefore indispensable for LogObject to be able to offer the LogObject Services and to carry out its business model.
LogObject endeavors to protect the security and confidentiality of the Data that LogObject receives, obtains from publicly available sources and/or otherwise processes in the course of its business activities.

This privacy policy sets out how and to what extent LogObject processes data and which data protection conditions apply to the use of LogObject services.
2. Legal basis
The processing of data is subject to Swiss law and, in certain cases, the law of the European Union, in particular the General Data Protection Regulation of the European Union (hereinafter "GDPR").
LogObject undertakes to comply with all relevant legal requirements and, as far as legally possible, also obliges its employees and third parties who process data on its behalf to do so, but without assuming any liability for this, as far as legally possible.
3. Data and processing of data
The processing of data generally begins with the start of the business relationship between LogObject and the customer or third parties who have another interest in LogObject (e.g. customers, suppliers, partners, applicants).
LogObject is also authorized to inform the Interested Person about LogObject services and/or other services and to process the data received from the Interested Person and/or third parties after an expression of interest, of whatever nature, by a person (hereinafter "Interested Person") in one or more LogObject services or in another service, product, website and/or other service of a business partner or advertising customer of LogObject (hereinafter "Other Services").
3.1 Data
In principle, all data, including personal data (see section 9.2), which are generated in the context of the LogObject Services or which are necessary for the provision of the LogObject Services in the sole judgment of LogObject shall be processed. This includes in particular, but is not limited to
- Data that customers communicate in the course of their contact with LogObject (e.g. via telephone, e-mail, online forms, etc.), including personal data (name, function within the employer's company, business address, business telephone number and business e-mail address (in the case of applicants regarding job offers, private contact details), company, company size);
- Automatically transmitted or generated usage data (e.g. date and time of use, previous and accessed page, IP address, data on the browser used, device identifier, current location, insofar as this information is released, etc.) in relation to LogObject websites or websites operated on behalf of LogObject (hereinafter "LogObject websites");
- Correspondence and other communication with the customer (e.g. e-mails, telephone calls, which may also be recorded where necessary);
This data can be linked to each other, even across several visits and contacts, if a customer or a profile is recognized, for example, on the basis of a user name, an e-mail address, a device identifier or "cookies" stored in the browser (see below).
3.2 Processing of data
LogObject processes data for the purpose of developing, offering against payment and free of charge, further developing and designing LogObject services, for internal training purposes and for quality control, for the maintenance and development of customer relationships, for the expansion of LogObject into other business areas, for obtaining offers from insurance companies and other service providers, for advertising and marketing purposes, to prevent, detect and combat misuse, to respond to legitimate governmental requests, for contract performance, generally for other commercial interests of LogObject and/or in connection with credit checks and debt collection activities, as well as with the enforcement of claims or other legal disputes concerning LogObject or in which LogObject has a legitimate interest or in which LogObject is involved.
Further purposes of use of the data may arise from the circumstances or from legal obligations or may be indicated when the data in question is collected.
3.3 Processing of data by third parties
LogObject may have the data processed by third parties, including abroad. LogObject shall ensure in an appropriate manner that these third parties only process the data in the way that LogObject is permitted to do (see Section 3.2). The customer hereby expressly authorizes LogObject to disclose the data to third parties, including abroad.
In exceptional individual cases (e.g. misuse), data may also be disclosed to third parties for purposes other than those listed in this data protection declaration or provided for by law, provided that applicable law is not violated. LogObject cannot control, guarantee or warrant that these third parties comply with the data protection provisions applicable to LogObject; they process the data for their own purposes and possibly also abroad, where there may be no legal data protection as in Switzerland.
Data may also be transferred abroad when data is passed on to third parties, in particular if social networks or other third-party services are used and/or linked with LogObject services.
3.4 Anonymized data
If LogObject receives use cases or data from customers or other third parties for functional tests for the creation of specifications or for testing the LogObject services to be provided, the customer or other third party shall be obliged to provide only anonymized data for these functional tests. The customer shall also be obliged to ensure that the anonymization is designed in such a way that the requirements of current data protection legislation are complied with in all cases and that no rights of third parties are infringed under civil and/or criminal law.
4. Storage of the data
The storage of data by LogObject is carried out in accordance with the provisions of applicable Swiss data protection law and, where applicable, European law, in particular the GDPR.
LogObject generally processes all data in Switzerland and stores it on systems in Switzerland or, if necessary, abroad. LogObject reserves the right to process or store the data outside Switzerland without informing the customer in advance, provided that the relevant provisions of data protection legislation are complied with.
LogObject shall take appropriate technical and organizational measures in the context of data storage and processing to prevent unauthorized access and other unauthorized processing. These measures are regularly reviewed and, if necessary, adapted, including by third parties commissioned by LogObject to operate its systems.
5. Data storage period
LogObject stores the data in accordance with legal requirements and complies with the relevant statutory retention periods and obligations.
After expiry of the relevant statutory retention periods and obligations or after expiry of the periods necessary for the prosecution or defense of claims (e.g. statute of limitations), the corresponding data is routinely deleted. Data that is not subject to retention periods and obligations will be deleted if its retention is no longer necessary for the LogObject services or for other interests of LogObject.
6. commercial communication
LogObject may from time to time send (including commercial) content in connection with LogObject services (hereinafter "LogObject News") to all customers who register with LogObject with an e-mail address or other electronic address or cell phone number.
By registering for the contact request, the customer consents to being contacted by LogObject, but can stop this at any time and free of charge. registration is logged in order to be able to prove the registration process in accordance with legal requirements. For this purpose, the time of registration and confirmation as well as the IP address may be stored.
7. Cookies
LogObject uses cookies on the LogObject websites.
If customers do not wish to take advantage of the cookies used, they can refer to the help function of their browsers to find out how to set their browser to prevent it from accepting new cookies or deleting existing cookies. Customers can also find out how to block all new cookies in their browser or what settings they need to make in order to be notified of new cookies.
The cookies that LogObject currently uses on the LogObject websites are as follows:
Website analysis: Google Analytics
Google Maps: LogObject uses the service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA for geographical localization. A cookie is only set when customers actively access the service by clicking a button. Privacy policy of the provider: www.google.com/policies/privacy/, Opt-Out: www.google.com/settings/ads/
8. Linking with third-party services
LogObject may use the services of third parties to process the data.
9. Social media
LogObject may use the offer of social media platforms and social media channels and be active there itself, offer and/or advertise its LogObject services there or get in contact with third parties and (potential) customers there. The General Terms and Conditions (GTC) and data protection declarations of the individual social media platforms and social media channels and their operators shall apply. LogObject assumes no liability for the content exchanged from the social media platforms and social media channels.
10. Advertising
LogObject advertises the LogObject services and LogObject websites online and offline. LogObject may use third-party services and process or have data processed directly or indirectly.
11. Server log files
Each time a user accesses the LogObject websites, the user's Internet browser automatically transmits the following data to LogObject's web server for technical reasons:
- IP address of the requesting computer
- Date and time of access
- Name and URL of the retrieved file
- Amount of data transferred
- Access status (file transferred, file not found, etc.)
- Identification data of the browser and operating system used
- Name of the provider of the user's internet access
- Website from which access is made
This data is collected, processed and used for the purpose of enabling the use of the LogObject websites (connection establishment), system security and the technical administration of the network infrastructure.
12. SSL encryption
The LogObject websites use SSL encryption for security reasons and to protect the transmission of confidential content, such as requests that the customer sends to LogObject. In the case of an encrypted connection, the address line of the browser changes from "http://" to "https://" and displays a lock symbol in the browser line.
If SSL encryption is activated, the data that the customer transmits to LogObject cannot be read by third parties.
13. Customer rights
The rights of customers with regard to the processing of data by LogObject are based on the relevant Swiss and, where applicable, foreign legal provisions.
The exercise of such rights requires that the identity of the data subject is clearly established. LogObject reserves the right to assert restrictions of the rights listed here provided for by law.
13.1 Right to information
Anyone may request information from LogObject as to whether data relating to him/her is being processed. LogObject will inform him/her of the following:
- all data available about him/her in the data collection, including the available information about the origin of the data;
- the purpose and, if applicable, the legal basis of the processing as well as the categories of data processed, the parties involved in the collection and the data recipients.
LogObject reserves the right to charge the customer for the costs incurred in the case of more extensive requests.
13.2 Personal data
Personal data is data containing information relating to an identified or identifiable person and any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Customers have the following additional, non-exhaustive rights with regard to the processing of personal data by LogObject:
- The right to free information about personal data stored about the customer, as well as the right to receive a copy of this information;
- The right to demand the immediate correction of incorrect personal data concerning the customer and, if necessary, the completion of incomplete personal data, also by means of a supplementary declaration.
- The right to obtain the erasure of personal data concerning the customer without undue delay where the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed, the customer's consent has been withdrawn by the customer, the processing has no legal basis, the customer has objected to processing and there are no overriding legitimate grounds for the processing and/or the processing is unlawful.
Further rights of the customer arise from the mandatory standards of Swiss and, if relevant, European law.
To exercise the aforementioned rights, the customer must contact LogObject directly and in writing.
The deletion of certain data may result in LogObject no longer being able to provide its services. In this case, LogObject is authorized to immediately terminate the business relationship with the Customer or to discontinue the provision of certain services, irrespective of other contractual agreements. The Customer acknowledges that the discontinuation of certain services by LogObject does not constitute a breach of contract by LogObject and/or does not release the Customer from its financial obligations.
14. Consent
Customers explicitly and expressly agree that LogObject may process the data as stated in this Privacy Policy.
Every customer has the right to withdraw their consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
The withdrawal of consent authorizes LogObject to immediately terminate the business relationship with the customer or to discontinue the provision of certain services, irrespective of other contractual agreements. the Customer acknowledges that the discontinuation of certain services by LogObject does not constitute a breach of contract by LogObject and/or does not release the Customer from its financial obligations.
15. Acceptance of the Privacy Policy
By using LogObject services, the Customer accepts this Privacy Policy without reservation.
LogObject services are only offered to natural persons of legal capacity or to existing legal entities. LogObject may exclude the use of LogObject services for certain persons at any time without giving reasons.
The data collected from customers when using LogObject services may be made available to third parties for further use and for the purpose of contacting customers and for the purpose of advertising customers by third parties. By using LogObject services, customers expressly agree to this disclosure of their data. Customers have the option at any time to refuse the forwarding of their data to third parties while continuing to use LogObject services.
In the event of false information or a breach of this data protection declaration by the customer, LogObject reserves the right to exclude the customer at any time from the use of LogObject services against payment or free of charge. LogObject also reserves the right to sue for damages incurred.
16. Exclusion of liability
LogObject expressly excludes - to the extent permitted by law - any liability for the LogObject services, the LogObject websites and for other damages arising from its business activities. LogObject assumes no liability that the use of the LogObject services and access to the LogObject websites is guaranteed continuously and without interruption.
All information about the LogObject services and on the LogObject websites is carefully checked. LogObject endeavors to ensure that the information provided is up-to-date, correct and complete. Nevertheless, the occurrence of errors cannot be completely ruled out, which means that LogObject cannot guarantee the completeness, accuracy and topicality of information, including journalistic and editorial information. Liability claims arising from material or immaterial damage caused by the use of the information provided are excluded.
LogObject may change or delete texts at its own discretion and without notice and is under no obligation to update the content of the LogObject websites. The use of or access to the LogObject websites is at the customer's own risk. LogObject-Websites is not responsible for damages, such as direct, indirect, accidental, pre-determined or consequential damages, which are caused by visiting the LogObject-Websites and therefore assumes no liability for them.
LogObject shall not be liable for links to the LogObject Websites, the LogObject Services or other information attributable to LogObject by third parties on social media platforms and social media channels, on third party websites or on other public and/or private platforms and channels. Furthermore, LogObject is not liable for the handling and use of LogObject services and LogObject websites by third parties.
In particular, LogObject shall not be liable for direct and/or indirect damages as well as consequential damages incurred by customers on the basis of data processed by LogObject by third parties. LogObject excludes any liability for the contacting and provision of information, newsletters and advertising of customers by third parties on the basis of the data processed by LogObject.
LogObject expressly distances itself from all third-party content that may be relevant under criminal or liability law or offend common decency.
For customers who are in a contractual relationship with LogObject, the liability provisions agreed in this contractual relationship shall take precedence over this section.
17. Updating
This Privacy Policy V2024.10.30 may be amended at any time and without prior notice. The current version published on the website logobject.com shall apply.
LogObject reserves the right to supplement or amend this privacy policy in individual cases with additional privacy policies.
18. Severability clause
Should a provision of this Privacy Policy or the contents of a supplement integrated into this Privacy Policy be or become invalid, this shall not affect the validity of the remainder of this Privacy Policy.
The invalid provision shall be replaced by a valid provision that comes as close as possible to the intended economic purpose of the invalid provision.
19. Applicable law and place of jurisdiction
For disputes arising from this privacy policy or for disputes concerning the data, Swiss law shall apply as far as legally possible, excluding conflict of laws rules.
The courts at LogObject's registered office shall, as far as legally possible, have jurisdiction over disputes arising from this Privacy Policy or disputes relating to the Data.
